Part IV: Calculators for Fees of Private Bailiffs
In this section, you will find two calculators: 1. for the debt collection fee, and 2. for a public sale fee.
Since private bailiffs are usually registered under the VAT Act, the calculators include VAT on the assessed fees.
1. Calculator for Debt Collection Fee
The first calculator in this category calculates the proportional fee collected by a Private Bailiff (PB) for executing monetary claims within the framework of execution proceedings. It is calculated based on the amount collected. It includes the amount of the monetary claim received in the Bailliff’s accounts and the amounts paid directly to the creditor after initiating the execution case.
The calculator does not include advance fees that PB may charge, such as initiating the execution case, serving a voluntary execution invitation, performing individual execution actions, etc., which depend on the specific execution case.
Please note that the calculator does not compute advance fees charged by PB, such as for the execution case initiation, serving a voluntary execution invitation, performing individual execution actions, etc., which depend on the management of the specific execution case.
2. Calculator for Public Sale Fees
The second calculator for PB fees computes the fee for preparing a decree for assignment to the successful buyers who participated in a public sale of real estate within the framework of execution proceedings and for bringing the buyers into possession of the property.
The calculator computes the fee based on the sale price — the amount at which the bidding ended, and the bidder was declared the property buyer. This is not the initial PB sale price per the public sale announcement.
